1. No Government Affiliation

Nuclear Advocates LLC is a private advocacy and claims-support service. We are not affiliated with, endorsed by, or operated by the U.S. Department of Labor, the Office of Workers' Compensation Programs, the Department of Energy, NIOSH, the Department of Justice, or any other federal agency. Eligibility and benefit decisions are made solely by the appropriate federal program. DOL Resource Centers provide free claim assistance nationwide; hiring a private representative is optional.

2. Not Legal Advice

Nuclear Advocates LLC is not a law firm and does not provide legal advice. Our services are focused on claim guidance, document support, eligibility review, and advocacy assistance. Information on this website is for general educational purposes only. If legal advice is needed, claimants should consult a licensed attorney.

3. No Guarantee of Benefits

Submitting information, completing an eligibility review, or working with Nuclear Advocates does not guarantee approval, compensation, medical benefits, claim acceptance, a White Card, or any specific outcome. Payment of a fee does not guarantee any particular result. Benefit determinations are made solely by the appropriate federal claims program.

4. Fees and Payment Terms

The initial eligibility review is free and no-obligation. If additional claim-support, document preparation, or representative services are requested, fees may apply. Any applicable fees will be explained clearly and in writing before services begin. No paid services start without a written agreement.

Representative fees for services in connection with EEOICPA claims pending before the OWCP are subject to federal regulations at 20 CFR §§ 30.602–30.603. Nuclear Advocates follows all applicable federal fee rules. The federal program does not pay representative fees; any representative fee is generally the claimant's responsibility. Any exact fee structure must match the written agreement signed by the claimant.

5. Claimant Responsibility

Claimants are responsible for the accuracy of information they provide. You agree to:

  • Provide accurate and complete information
  • Respond promptly to requests for documentation
  • Notify us of any changes in your contact information or medical status
  • Review all fee terms carefully before signing any agreement

6. Accuracy of Information Submitted

You represent that all information submitted to Nuclear Advocates LLC is accurate to the best of your knowledge. Submitting false or misleading information may affect claim outcomes and could have legal consequences under applicable federal program rules.

7. Document Handling

Because claim-related documents may contain sensitive personal, medical, employment, or survivor information, users should only submit documents through the secure Claimant Portal after authentication. Nuclear Advocates implements appropriate measures to protect submitted information. We do not sell claimant information. Documents uploaded through the portal are stored securely and are accessible only to authorized users as determined by role-based access controls enforced at the database level.

8. Claimant Portal Account Security

If you are invited to use the Claimant Portal, you are responsible for maintaining the security of your account credentials. You agree to:

  • Keep your password confidential and not share it with others
  • Notify us immediately if you believe your account has been compromised
  • Use a strong, unique password
  • Log out of the portal when you are finished, especially on shared devices

Portal access is provided through secure, single-use invitation tokens. Invitations expire and cannot be reused. Access to case records is restricted to your own case; you cannot access another claimant's information by modifying URLs or record IDs — this is enforced server-side.

9. Electronic Communications

By using this website and the Claimant Portal, you consent to receive electronic communications from Nuclear Advocates, including email notifications, portal messages, and billing communications. You acknowledge that electronic communications may not be secure and that you should not include sensitive medical details in unencrypted email. Sensitive information should be submitted through the secure Claimant Portal.

10. Authorized Representative

Claimants are not required to have an authorized representative. Representation is optional. A claimant may generally designate only one representative at a time and retains the authority to appoint or remove a representative at any time. A properly appointed authorized representative may communicate with DEEOIC, receive information, and submit appropriate information on the claimant's behalf. However, representatives do not have authority to sign certain claimant-only forms (such as EE-1, EE-2, and EN-20 forms) on behalf of the claimant. The claimant must sign these forms personally.

11. Intellectual Property

All content on this website, including text, graphics, logos, and design elements, is the property of Nuclear Advocates LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this website without our prior written consent.

12. Termination

Nuclear Advocates may suspend or terminate portal access if a user violates these Terms, compromises portal security, or engages in fraudulent activity. Claimants may stop using the services at any time. Termination of services does not relieve either party of obligations incurred prior to termination, including fee obligations under a signed agreement.

13. Limitation of Liability

Nuclear Advocates LLC's liability is limited to the services described in any applicable written agreement. We are not responsible for federal agency decisions, claim outcomes, or consequences arising from information submitted by users. We do not guarantee any claim result. In no event shall Nuclear Advocates LLC be liable for indirect, incidental, special, or consequential damages arising from the use of this website or our services.

14. Governing Law

These Terms of Service are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any disputes arising from these Terms or the use of this website shall be resolved in the courts of Clark County, Nevada, to the extent permitted by law.

15. Updates to Terms

We may update these Terms of Service from time to time. Material changes will be reflected by updating the "Last Updated" date at the top of this page. Your continued use of the website or services after changes constitutes acceptance of the updated Terms.

16. Acceptance of Terms

By accessing and using the Nuclear Advocates LLC website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
